Professional designations/rules

The professional designation “lawyer” (Federal Republic of Germany) is awarded in accordance with German law after passing the 2nd State Bar Examination and following a special certification procedure by the responsible Ministry of Justice by the President of the relevant responsible State Court of Appeals, or on the grounds of the changed legal circumstances prevailing since 08.09.1998 by the responsible local bar association (see above under Bar associations/Supervisory authority). Lawyers are subject to the professional regulations of the ‘Bundesrechtsanwaltsordnung (BRAO)’, the ‘Rechtsanwaltsvergütungsgesetz (RVG)’, the ‘Berufs- und Fachanwaltsordnungen der Bundesrechtsanwaltskammer (BORA 2001 and FAO)’ and the regulations on professional ethics for lawyers in the European Community.
